1.Acceptance of Terms

By accessing and using TEZELA ("Service"), you accept and agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not use the Service. We reserve the right to modify these terms at any time, with changes taking effect immediately upon posting.

2.Service Description

TEZELA is an automated website design generation platform that analyzes existing websites and generates multiple design variations. The Service provides features including URL input, intelligent design analysis, multiple design variant generation, live preview capabilities, and HTML/CSS export functionality.

3.User Accounts & Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration. You must be at least 18 years old or have parental/guardian consent to use this Service. You agree to use the Service only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Service.

4.Credits and Usage

Service usage is based on a credit system. Each website generation consumes one credit. Credits are purchased in advance and never expire. Credits are non-transferable between accounts. Rate limits may be enforced to ensure fair access and system stability for all users. Attempting to circumvent technical limitations or abuse the Service is prohibited.

5.Intellectual Property Rights

Generated design variants are provided for your use, modification, and distribution as needed for your website projects. You retain all rights to your original website content and source materials. TEZELA retains all rights to its AI models, algorithms, platform technology, and underlying infrastructure. You may not reverse engineer, decompile, or attempt to extract proprietary technology from generated designs.

6.Prohibited Uses

You agree not to use the Service to: (a) generate content for illegal purposes or that violates applicable laws; (b) infringe upon third-party intellectual property, copyrights, trademarks, or patents; (c) generate content that is abusive, harassing, defamatory, or obscene; (d) scrape, crawl, or systematically access the Service in ways not expressly permitted; (e) attempt to gain unauthorized access to the Service or its systems; or (f) use the Service to compete with TEZELA's core business.

7.Service Availability

TEZELA provides the Service "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted uptime or error-free operation. While we strive to maintain high availability, scheduled maintenance and unplanned outages may occur. We are not liable for any damages resulting from Service unavailability, data loss, or errors in generated designs.

8.Limitation of Liability

To the maximum extent permitted by applicable law, TEZELA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages. This includes damages for loss of profits, revenue, data, use, or other intangible losses. Our total liability under these terms shall not exceed the amount you paid us in the 12 months preceding your claim.

9.Payment and Billing

Credits are purchased as one-time payments processed through Stripe. We accept credit cards and other payment methods supported by Stripe. You authorize us to charge your payment method for the credits you purchase. All credit purchases are final. Credits are non-refundable except where required by applicable law. Purchased credits never expire and remain in your account until used.

10.Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, if we determine you have violated these terms. You may terminate your account at any time through your account settings. Upon termination, your right to access the Service ends immediately. Any unused credits and data associated with your account may be permanently deleted after 30 days.

11.Changes to Terms

We may update these terms from time to time. We will notify you of significant changes via email. Your continued use of the Service following notification of changes constitutes your acceptance of the new terms. Please review these terms periodically for updates.

12.Governing Law

These terms are governed by and construed in accordance with the laws of the jurisdiction where TEZELA operates, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts in that jurisdiction for any disputes arising from these terms.
